Terms & Conditions

These Terms & Conditions govern the use of our website, the purchase of bespoke/made-to-measure garments, and the hire of highlandwear from SETT. By placing an order, making a booking, or using our website, you agree to be bound by these Terms & Conditions. Please read them carefully.

Measurements & Fit

Any garments that do not fit due to incorrect measurements provided by you cannot be refunded.
For in-store fittings, our team will take measurements and confirm sizing with you before production or hire.

Orders, Deposits & Payments

All orders must be paid in full before delivery or collection. Delayed payments will result in delayed delivery.
For bespoke suit orders, once you have chosen your design, you must sign a design approval form and pay a non-refundable deposit of 50% of the order value.
For made-to-measure highlandwear, a 50% deposit will be taken to confirm the order.

For highlandwear hire:

Individual hires must be paid in full at the point of sale.
For weddings or group bookings, a 50% deposit is required at the point of sale, with the balance due 4 weeks before collection.

Production & Delivery

Bespoke garments may take up to 16 weeks for manufacture and delivery.
If order is to be delivered, responsibility for your orders safe delivery passes to the courier. We are not liable for delays, damage, or loss once the item is in transit.
SETT reserves the right to halt or delay hire orders to certain locations (e.g. Scottish Islands) during periods of severe weather or exceptionally high demand.

Website Use

We do not guarantee that our website will be uninterrupted, error-free, or free of viruses. Access is at your own risk.
Content on our website is provided “as is” without guarantees of accuracy. We reserve the right to correct errors, update information, withdraw services, or amend content at any time.
Except where required by contract law, SETT and its employees will not be liable for any loss or damage arising from use of our website.

Social Media Competitions

Competitions are open only to UK residents aged 18 and over, excluding employees, families, and affiliates of SETT.
Entry requirements will be detailed in the relevant social media post. By entering, you are deemed to accept these Terms & Conditions.
The prize is as stated and non-transferable; no cash alternative is available.
Late, bulk, or fraudulent entries will not be accepted.
Winners will be notified after the competition closes. If a winner does not respond within a reasonable timeframe, SETT reserves the right to select an alternative winner.
Competitions are not sponsored or endorsed by Facebook, Instagram, TikTok, Twitter or any other platform.
By entering, you agree that your data may be processed in accordance with our Privacy Policy.

Hire Terms

Kilt hire is provided by Macgregor and MacDuff and as such, orders will fall under their hire terms and conditions.
If one member of a party collects multiple orders, that person is responsible for all items collected.
ID Requirements: At least two forms of ID are required:
- One valid photo ID (passport or driving licence).
- One recent proof of address dated within the last 3 months (bank or utility bill, paper or digital).
Hirers are responsible for the cost of lost, stolen, or damaged items (unless covered by Accidental Damage Waiver).
Heavily soiled outfits may incur an additional cleaning fee of up to £50; in extreme cases, replacement costs may apply.
Failure to return a hire outfit may result in details being passed to a debt collection agency.

Cancellations & Refunds (Hire)

If you cancel a hire order, a £40 cancellation fee will be deducted, and the remaining balance of your deposit refunded.
If the deposit paid was less than £40, the full deposit will be retained.
For “Choose Any Tartan Hire” orders, the full deposit is non-refundable.
All hire outfits must be paid in full within 12 weeks of the hire date. Payments are non-refundable if cancelled within this period.

Customer Responsibilities

Outfits must be returned in good condition and on time.
Any breach of these Terms & Conditions may result in termination of hire services.
By collecting your hire, you confirm acceptance of these Terms & Conditions and accept responsibility for the items collected.

Indemnity

You agree to indemnify SETT, its directors, employees, suppliers, or representatives against any claims, losses, or expenses (including reasonable legal fees) resulting from your breach of these Terms & Conditions or misuse of our website or services.

Amendments

SETT reserves the right to amend these Terms & Conditions at any time. Changes will be posted on our website, and continued use of our site or services signifies acceptance of the updated terms.

Governing Law

These Terms & Conditions are governed by Scots Law. In the event of any dispute, the matter will be dealt with exclusively by the Scottish courts.
